Wheeling Tire (doing business as Wheeling Tire, "we," "us," or "our") provides the website at https://www.wheelingtire.com/ (the "Site"). These Terms of Use ("Terms") govern your access to and use of the Site and the related features we offer through it, such as online quoting, tire shopping, appointment requests, messaging, and payments.

1. About this Site and the services that power it

Our Site and several of the tools on it are provided by third-party technology partners. We are responsible for the Site we offer to you, but you should know that:

  • Our Site and its features are powered by TireTutor, our website and software platform provider. Depending on our package and the features enabled on this Site, TireTutor may provide our website, online quoting, scheduling, point-of-sale, payments, messaging, call handling and call recording, online tire and wheel/fitment tools, and similar services. Your use of TireTutor-powered features may also be subject to the TireTutor Terms of Use (https://tiretutor.com/terms-of-use) and TireTutor Privacy Policy (https://tiretutor.com/privacy-policy).
  • Where online tire shopping is offered on our Site, it may be provided through TIRESanytime®, an application from U.S. AutoForce. Your use of that feature is also subject to the TIRESanytime / U.S. AutoForce terms and privacy policy ([INSERT TIRESANYTIME / US AUTOFORCE TERMS URL]).
  • Where service or repair appointment booking is offered on our Site, it may be provided through RepairAnytime, an application from U.S. AutoForce. Your use of that feature is also subject to the RepairAnytime / U.S. AutoForce terms and privacy policy ([INSERT REPAIRANYTIME / US AUTOFORCE TERMS URL]).

These partners maintain their own terms and policies. Where a third-party feature is governed by its provider's terms, those terms apply to that feature in addition to these Terms.

2. Who may use the Site

The Site is intended for adults. You must be at least 18 years old (or the age of majority in your state) to make a purchase, book service, or enter into a transaction through the Site. The Site is not directed to children under 13, and we do not knowingly allow children under 13 to use it (see the Children's section of our Privacy Policy). By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

3. Accounts

If the Site offers accounts and you create one, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.

5. Products, quotes, pricing, and availability

Where the Site shows products, prices, or quotes, that information is provided for convenience and may contain errors or change without notice. Quotes and online prices are estimates and are not a binding offer; final pricing, applicable fees, taxes, and availability are confirmed at the time of purchase or service. Tire and parts fitment depends on your specific vehicle, and you are responsible for confirming the correct product with us. Inventory is not guaranteed and may be sourced through our suppliers. We may correct errors, update information, or cancel an order or quote affected by an error, even after it is submitted.

6. Orders, payment, and taxes

Where the Site accepts orders or payment, submitting an order is an offer to purchase; an order is accepted only when we confirm it or provide the product or service. Payment is processed by our third-party payment processor, and by submitting payment information you authorize the applicable charges, including taxes and disclosed fees. We May decline or cancel orders, including for suspected error, fraud, or unavailability, and will arrange a refund of amounts paid for canceled orders as applicable. Returns, exchanges, and refunds are handled under our then-current policies and applicable law.

7. Appointments and services

Where the Site offers appointment booking or service requests, an appointment request submitted through the Site is a request, not a confirmed booking, until we confirm it. Service estimates are approximate and may change after inspection; we will seek your authorization before performing work that exceeds an authorized estimate where required. You are responsible for providing accurate vehicle information and for following any cancellation or no-show requirements we communicate.

8. Communications and consent

By providing your contact information, you agree that we may contact you about your quotes, orders, appointments, and inquiries, and—where permitted—send marketing communications.

  • Calls and recording. Where required, we provide notice that calls may be recorded, and continuing a call after that notice indicates your consent, as described in our Privacy Policy.
  • Text messages. If you opt in to text messages, message and data rates may apply; reply STOP to opt out or HELP for help. Consent to marketing texts is not a condition of any purchase.
  • Email. We send marketing emails, which include an unsubscribe link; you may still receive transactional messages needed to provide our services.
  • Electronic communications. You agree that we may provide notices, disclosures, and records (including transaction records) to you electronically, and that electronic agreements, confirmations, and records satisfy any requirement that they be in writing, to the extent permitted by law.

Trademarks and brand names on the Site are the property of their respective owners and may not be used without permission.

11. Reviews and submissions

If the Site lets you submit a review, comment, photo, or other content and you do so, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business, and you represent that you have the right to submit it and that it is accurate and not unlawful. We may remove content at our discretion. We do not condition reviews on a positive rating, consistent with applicable law.

12. Third-party apps, services, and links

The Site relies on and links to third-party apps and services, including TireTutor (platform), our payment processor, analytics and advertising providers, call-tracking services, and—where enabled—U.S. AutoForce applications (TIRESanytime / RepairAnytime). Your use of those features may be governed by the third party's own terms and privacy policies, and we are not responsible for third-party websites, content, or practices. 13. Disclaimers

The Site and its features are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Product and service warranties, where they apply, are provided separately (for example, by the manufacturer or under a written warranty we provide) and are not affected by this Site disclaimer. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site is limited to the amount you paid, if any, for the transaction giving rise to the claim. 16. Dispute resolution and governing law

These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws rules. Subject to any arbitration provision below, the state and federal courts located in Ohio County, West Virginia will have jurisdiction over disputes relating to the Site or these Terms.

We may suspend or terminate your access to the Site at any time if you violate these Terms or to protect the Site, our customers, or our business. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

19. Miscellaneous

These Terms, together with our Privacy Policy and any terms applicable to specific features, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
